Evicted Tenant not Welcome on Estate
East Durham Homes has taken further action against a former tenant following his threatening behaviour to residents.
Ronald Fitzharris (28) previously lived in a flat in Brecon Close, Peterlee when East Durham Homes were made aware of his threatening behaviour, which included shouting abuse and threatening neighbours with violence, playing loud music, banging and slamming doors late at night.
Mr Fitzharris was served with an anti social behaviour injunction by East Durham Homes following a hearing at Hartlepool County Court in December 2007. This injunction was in force whilst possession proceedings in respect of his tenancy, were awaited. Under the terms of the injunction Mr Fitzharris was forbidden from engaging in behaviour which would intimidate, harass, threaten or cause nuisance to people in the neighbourhood.
On the 29th February 2008, following a further hearing at Hartlepool County Court, East Durham Homes was granted possession of the property and Mr Fitzharris was evicted on the 31st March 2008.
Mr Fitzharris has now been served with a further injunction which excludes him from the Brecon Close area of Peterlee. This injunction is in force until the 13th December 2008 and includes the power of arrest. This means that if a breach is suspected, Fitzharris can be arrested and brought before a judge. A breach of an injunction could lead to a period of imprisonment.
Paul Tanney, East Durham Home Chief Executive said: “People have the right to live in peace and quiet and East Durham Homes will take whatever action is necessary to protect that right.”
He added: “This case demonstrates to the public how East Durham Homes are working closely with the police and are taking effective action to deal with anti-social behaviour”.
