Selling your home
Do I need permission to sell my home?
No, you do not need our permission to sell your property.
Will I need to repay any of the right to buy discount?
If you purchased the property from the council under right to buy, you will need to repay all or some of the discount, depending on when you made your application to buy the property.
If you made your application before 18th January 2005 and sell within three years of your purchase, the amount you have to repay depends on how long you have held the lease, as follows:
- Within 1 year - 100%
- Within 2 years - 66%
- Within 3 years - 33%
- After 3 years - Nil
If you made your application on or after 18th January 2005 and you sell within five years of your purchase, the amount you have to repay depends on how long you have held your lease and the market value at the time of resale.
As with any property sale, you may either instruct an estate agent to sell the property on your behalf, or sell the property yourself. Either way, you must ensure that all prospective purchasers are aware of the leasehold nature if the property and of any rules and conditions which apply.
Please ask your solicitor to contact East Durham Homes leasehold section to obtain full details of the lease and of the service charges payable.
Please note that all outstanding service charges must be paid prior to completion of your sale.
